ROSENTHAL, SCHIMEL, DINOWITZ, PAULIN, WEISENBERG, JAFFEE, COOK, MAISEL -- read once and referred to the Committee on Economic Development AN ACT to amend the general business law, in relation to age require- ments for gun shows THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Paragraphs (b) and (c) of subdivision 1 of section 896 of 2 the general business law, as added by chapter 189 of the laws of 2000, 3 are amended and a new paragraph (d) is added to read as follows: 4 (b) notify all firearm exhibitors in writing that a national instant 5 criminal background check must be completed prior to all firearm sales 6 or transfers, including sales or transfers of rifles or shotguns; [and] 7 (c) provide access at the gun show to a firearm dealer licensed under 8 federal law who is authorized to perform a national instant criminal 9 background check where the seller or transferor of a firearm, rifle or 10 shotgun is not authorized to conduct such a check by (i) requiring 11 firearm exhibitors who are firearm dealers licensed under federal law 12 and who are authorized to conduct a national instant criminal background 13 check to provide such a check at cost or (ii) designating a specific 14 location at the gun show where a firearm dealer licensed under federal 15 law who is authorized to conduct a national instant criminal background 16 check will be present to perform such a check at cost. Any firearm deal- 17 er licensed under federal law who performs a national instant criminal 18 background check pursuant to this paragraph shall provide the seller or 19 transferor of the firearm, rifle or shotgun with a copy of the United 20 States Department of Treasury, Bureau of Alcohol, Tobacco and Firearms 21 Form ATF F 4473 and such dealer shall maintain such form and make such 22 form available for inspection by law enforcement agencies for a period 23 of ten years thereafter[.]; AND 24 (D) PROHIBIT ENTRANCE TO THE GUN SHOW OF ANY PERSON WHO IS UNDER THE 25 AGE OF TWELVE YEARS OF AGE. 26 S 2.
