A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the election of directors of certain electric |
|
|
cooperatives. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter B, Chapter 161, Utilities Code, is |
|
|
amended by adding Section 161.0721 to read as follows: |
|
|
Sec. 161.0721. ELECTION OF DIRECTORS IN CERTAIN LARGE |
|
|
COOPERATIVES. (a) This section applies only to an electric |
|
|
cooperative with more than 200,000 members that is partially |
|
|
located in a county with a population of more than one million and |
|
|
less than 1.5 million. |
|
|
(b) To be elected as director for a district, a candidate |
|
|
must receive a majority of the total number of votes received for |
|
|
that office. |
|
|
(c) If no candidate for director of a particular district |
|
|
receives the vote necessary to be elected, a runoff election for |
|
|
that office is required. |
|
|
SECTION 2. The changes in law made by Section 161.0721, |
|
|
Utilities Code, as added by this Act, apply only to an election held |
|
|
on or after the effective date of this Act. An election held before |
|
|
the effective date of this Act is subject to the law in effect on the |
|
|
date the election is held, and that law is continued in effect for |
|
|
that purpose. |

|
SECTION 3. This Act takes effect September 1, 2015. |
