          AN ACT

        relating to the employment of persons under 18 years of age on the  | 
      
      
        | 
           
			 | 
        premises of certain businesses selling or serving alcoholic  | 
      
      
        | 
           
			 | 
        beverages; adding a provision that is subject to a criminal  | 
      
      
        | 
           
			 | 
        penalty. | 
      
      
        | 
           
			 | 
               BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | 
      
      
        | 
           
			 | 
               SECTION 1.  Section 106.09, Alcoholic Beverage Code, is  | 
      
      
        | 
           
			 | 
        amended by amending Subsection (a) and adding Subsection (f) to  | 
      
      
        | 
           
			 | 
        read as follows: | 
      
      
        | 
           
			 | 
               (a)  Except as provided by [in] Subsections (b), (c), [and]  | 
      
      
        | 
           
			 | 
        (e), and (f) [of this section], no person may employ a person under  | 
      
      
        | 
           
			 | 
        18 years of age to sell, prepare, serve, or otherwise handle liquor,  | 
      
      
        | 
           
			 | 
        or to assist in doing so. | 
      
      
        | 
           
			 | 
               (f)  The holder of a permit or license providing for the  | 
      
      
        | 
           
			 | 
        on-premises consumption of alcoholic beverages that derives less  | 
      
      
        | 
           
			 | 
        than 50 percent of its gross receipts for the premises from the sale  | 
      
      
        | 
           
			 | 
        or service of alcoholic beverages may employ a person under 18 years  | 
      
      
        | 
           
			 | 
        of age to work as a cashier for transactions involving the sale of  | 
      
      
        | 
           
			 | 
        alcoholic beverages if the alcoholic beverages are served by a  | 
      
      
        | 
           
			 | 
        person 18 years of age or older. | 
      
      
        | 
           
			 | 
               SECTION 2.  The change in law made by this Act to Section  | 
      
      
        | 
           
			 | 
        106.09, Alcoholic Beverage Code, applies only to an offense  | 
      
      
        | 
           
			 | 
        committed on or after the effective date of this Act.  An offense  | 
      
      
        | 
           
			 | 
        committed before the effective date of this Act is covered by the  | 
      
      
        | 
           
			 | 
        law in effect when the offense was committed, and the former law is  | 
      
      
        | 
           
			 | 
        continued in effect for that purpose.  For purposes of this section,  | 
      
      
        | 
           
			 | 
        an offense was committed before the effective date of this Act if  | 
      
      
        | 
           
			 | 
        any element of the offense occurred before that date. | 
      
      
        | 
           
			 | 
               SECTION 3.  This Act takes effect immediately if it receives  | 
      
      
        | 
           
			 | 
        a vote of two-thirds of all the members elected to each house, as  | 
      
      
        | 
           
			 | 
        provided by Section 39, Article III, Texas Constitution.  If this  | 
      
      
        | 
           
			 | 
        Act does not receive the vote necessary for immediate effect, this  | 
      
      
        | 
           
			 | 
        Act takes effect September 1, 2015. |
