          AN ACT

        relating to the unlawful possession of a firearm by persons placed  |

        on deferred adjudication community supervision for certain felony  | 
      
      
        | 
           
			 | 
        offenses; creating a criminal offense. |

			 | 
               BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | 
      
      
        | 
           
			 | 
               SECTION 1.  Section 46.04, Penal Code, is amended by adding  | 
      
      
        | 
           
			 | 
        Subsection (a-1) to read as follows: | 
      
      
        | 
           
			 | 
               (a-1)  A person who has been placed on deferred adjudication  | 
      
      
        | 
           
			 | 
        community supervision for a felony listed in Article 42A.054(a),  | 
      
      
        | 
           
			 | 
        Code of Criminal Procedure, commits an offense if the person  | 
      
      
        | 
           
			 | 
        possesses a firearm during the person's period of supervision. | 
      
      
        | 
           
			 | 
               SECTION 2.  The change in law made by this Act applies to a  | 
      
      
        | 
           
			 | 
        person on deferred adjudication community supervision on or after  | 
      
      
        | 
           
			 | 
        the effective date of this Act, regardless of whether the person was  | 
      
      
        | 
           
			 | 
        placed on deferred adjudication community supervision before, on,  | 
      
      
        | 
           
			 | 
        or after the effective date of this Act. | 
      
      
        | 
           
			 | 
               SECTION 3.  This Act takes effect September 1, 2019. |
